ACTION BY
THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION
Notice is given that the Department’s Final Agency Action is approval of the application to the State 404 Permit Program to widen approximately 2.56 miles of State Road (SR) 50 and construction of sidewalks from west of Buck Hope Road to west of Jefferson Street in Hernando County. The project is located in Sections 26, 27, and 28, Township 22 South, Range 19 East. The permit applicant is the Florida Department of Transportation (FDOT) District 7, c/o Joel Johnson, Environmental Permits Coordinator, whose address is 11201 North Malcolm McKinley Drive, MS 7-800, Tampa, Florida 33612. The Permit No. is 0404725-002-SFI. The file(s) pertaining to the project referred to above is available for inspection at the Department’s Electronic Document Management System (OCULUS) at https://depedms.dep.state.fl.us/Oculus/servlet/login .
NOTICE OF RIGHTS
Any person whose substantial interests are affected by the Department’s action regarding this matter may request an administrative hearing in accordance with Sections 120.569 and 120.57, Florida Statutes (F.S.), and Chapter 28-106, Florida Administrative Code (F.A.C.), of the Uniform Rules of Procedure. A request for hearing must (1) explain how the substantial interests of each person requesting the hearing will be affected by the Department’s action, or proposed action; (2) state all material facts disputed by each person requesting the hearing or state that there are no disputed facts; and (3) otherwise comply with Chapter 28-106, F.A.C. A petition for hearing must be filed with and received by the Clerk of the Department in the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000, or via electronic correspondence at [email protected] . Also, a copy of the petition shall be mailed to the applicant at the address noted above or at [email protected] . The petition for hearing must be received by the Department within 21 days of this publication. Failure to file a petition for hearing within this time period shall constitute a waiver of that person’s right to request an administrative determination (hearing) under Sections 120.569 and 120.57, F.S. or to intervene in this proceeding and participate as a party to it.
Mediation pursuant to Section 120.573, F.S., to settle an administrative dispute regarding the Department’s action in this matter is not available prior to the filing of a request for hearing.
